Domain Registration Agreement
Specific conditions for registering, renewing and transferring domains.
This English text is provided for information. The contract is governed by Argentine law and the Spanish version is the one that binds, under clause 32.1. Read the binding Spanish version
1 Purpose and scope
1.1 This Domain Registration Agreement, hereinafter the “Agreement”, governs the registration, renewal, transfer and administration of domain names contracted from Sitios Hispanos SRL, hereinafter “SitiosHispanos.Com”.
1.2 It forms part of the General Terms and Conditions of Service under their section 2.1 and develops their section 21. In the event of a divergence, the more specific document delivered before acceptance prevails.
1.3 Domains are not governed by the retention windows in section 25 of the Terms, but by the stages and periods set by each registry or registrar.
2 Role of SitiosHispanos.Com
2.1 SitiosHispanos.Com acts as an intermediary or reseller before the applicable registry or registrar. It is not the domain registry and does not set its policies, fees or periods.
2.2 SitiosHispanos.Com works with NIC Argentina for .ar domains and with ICANN-accredited registrars for generic extensions. The registrar involved in each operation is disclosed at the registrant’s request.
2.3 Availability reported by the checker is provisional. Only confirmation by the registry or registrar completes the operation.
3 Ownership and registrant details
3.1 The registrant holder retains the rights over the domain in accordance with the applicable rules. Contracting through SitiosHispanos.Com does not transfer those rights.
3.2 The registrant must provide accurate and complete information and keep the registrant, administrative, technical and billing contacts up to date.
3.3 Contact details may be published or communicated to the registry under the policies of the extension. SitiosHispanos.Com has no decision-making power over that publication.
3.4 The registrant must respond to the verifications required by the registry or registrar. Failure to respond may lead to suspension of the domain by decision of that third party.
3.5 The policies of NIC Argentina, of ICANN and of the registry and registrar corresponding to each extension apply.
4 Registration and transfer
4.1 Acceptance and payment do not guarantee registration or transfer. It may not proceed if the domain ceases to be available, a restriction of the extension exists, the authorisation code is missing, the registry rejects the data, or a third party exercises a preferential right.
4.2 Where the operation is not carried out, the amount corresponding to the unperformed procedure is refunded.
4.3 Once the registry or registrar has executed the operation, its fees and charges are non-refundable, save for an error attributable to SitiosHispanos.Com or a mandatory rule.
4.4 An inbound transfer requires the domain to be transferable, that no locks exist, and that the registrant provides the authorisation code where the extension requires it.
5 Renewal and expiry
5.1 The registrant is responsible for renewing by the deadline stated. That date may fall before the expiry date published by the registry, to allow for processing; the difference is shown clearly under section 8.5 of the Terms.
5.2 SitiosHispanos.Com sends the notices provided for in section 8 of the Terms and, for domains subject to ICANN, the reminders required by its policies.
5.3 Failure to receive a notice does not extend the term of the domain if the notices were reasonably sent. SitiosHispanos.Com will not invoke this rule if it cannot evidence that it made the information available.
5.4 After expiry there may be grace, redemption, restoration, auction or release periods, with charges and conditions set by third parties. Those periods are not a free extension of the registration.
5.5 SitiosHispanos.Com does not guarantee the recovery of an expired domain.
6 Outbound transfer
6.1 Transfer to another registrar is facilitated where the domain is transferable and there are no regulatory locks, reasonably investigated fraud, or enforceable obligations connected with the procedure.
6.2 No obstacles outside the applicable rules are imposed, and departure is not conditioned on contracting other services.
6.3 The authorisation code is provided to the registrant or to whoever they authorise, subject to reasonable identity verification.
7 Disputes over ownership
7.1 Disputes over ownership, trade marks or bad-faith use may be subject to mandatory procedures, including those of NIC Argentina, the UDRP or the URS.
7.2 SitiosHispanos.Com complies with the valid decisions and orders it receives within those procedures.
7.3 SitiosHispanos.Com does not act as a tribunal and does not resolve those disputes, under section 12.11 of the Terms.
8 Suspension and content
8.1 Use of the domain is subject to the Acceptable Use and Abuse Reporting Policy.
8.2 A measure over hosted content does not by itself imply a measure over the domain, and vice versa. Each is adopted with the proportionality that corresponds to it.
8.3 Measures that a registry or registrar adopts over a domain under its own policies fall outside the control of SitiosHispanos.Com, which will inform the registrant of what it knows.
9 Term and version
9.1 This Agreement may be updated. Material changes are notified following the procedure in section 28 of the Terms.
9.2 The applicable version is the one identified at the foot of this document.
